Terms and Conditions for the LEGO® Account and LEGO VIP Membership Program

If you want to become a LEGO® Account - and LEGO VIP Membership Program (“Program”) member (“Member”), you must agree to be bound by these LEGO Account – and VIP Membership Program Terms and Conditions (“Terms and Conditions”). Please read these Terms and Conditions carefully before you submit to us your application to become a Member. The Program covers the incentives and rewards schemes described in these Terms and Conditions. The Terms and Conditions tell you who we are, how we will provide our services to you, how you or we may change or end the contract that these Terms and Conditions constitute between us, and other important information. By creating an Account or participating in the Program, you unconditionally accept and agree to comply with these Terms and Conditions.

1. General

Who are we?

We are LEGO System A/S, Aastvej 1, DK-7190 Billund, Denmark, Central business registration number 47458714 (“LEGO Group” or “we”). LEGO System A/S is part of the LEGO Group of companies. Read more about us here. When we refer to the LEGO Group in these Terms and Conditions, this automatically includes a reference to LEGO System A/S as well.

To what and whom these Terms and Conditions apply

The Program is a membership loyalty program that allows you to enjoy certain benefits and advantages as a Member and enables you to use your Program account (“LEGO Account”) to access validated apps and platforms in our LEGO® branded ecosystem (collectively “Services”) or facilitate that your child accesses such Services.  Please note that additional terms and conditions applies to the individual Services and will be presented to you, prior to your use of such individual Service. For instance, to play a game in an app, acceptance of the specific terms and conditions associated with that game is required.

Please note that while both adults and children may become a Member, Children will only be able to enjoy the child appropriate Services their parent or legal guardian has allowed the child to participate in. Once the child is of an age to be required to indicate their own decisions regarding processing of their personal information further use of the Services will be dependent on the child updating their preferences and providing consent where needed, as well as providing appropriate personal information (name and email address) to allow LEGO to contact the child directly if needed. Once the child reaches the age of maturity the child must accept the full Terms and Conditions of the Program to continue to use the Services and will at this time also have the option to sign up to receiving tailored marketing communications.

We will refer to you in these Terms and Conditions as “you” and/or as “Member”.

2. LEGO® Account

What is a LEGO® Account?

Your LEGO® Account profile contains your personal information and enables a quick and reliable identification of you. The LEGO Account is the personal and private user profile created by you in order to gain access to the Program and the various Services provided as part of the Program as well as our other various online LEGO services and applications at LEGO.com, in LEGO apps or in other digital products and services from the LEGO Group in our apps and platforms. If you are a parent or legal guardian to a child, your LEGO Account will also serve as the tool to create an account for your child.

What information is required to create a LEGO Account?

When creating a LEGO Account, we require your personal data, such as first name, last name, email address, date of birth and state/province/city and country of residence. How do I update my LEGO Account?

It is very important that you update your LEGO Account information so we can ensure we are providing you with a compliant and relevant experience at all times. Your personal information can be updated at any time by accessing your LEGO Account page. Date of birth cannot be updated for legal reasons, but parents’/guardian’s email address may be changed by contacting our Customer Service, here: https://www.lego.com/service/contact-us.

Who may create a LEGO Account and sign up to the Program?

The Program is not associated with any monetary payment and any natural person acting in their capacity as a private consumer or user in a country where the Program is offered may apply to become a Member and create a LEGO Account. Corporations, associations, or other groups or legal entities, may not apply for becoming a Member of the Program and create a LEGO Account.  

As children’s online safety is a priority for the LEGO Group, children and young adults who cannot give a legally valid acceptance of these Terms and Conditions themselves will be asked to involve parents or a legal guardian in the Membership signup process. The parent or legal guardian will receive a LEGO Account activation email and will be asked to finalize the profile creation process.

Acceptance of LEGO® rules of conduct

As owner of a LEGO Account and a Member of the Program, you must accept the following:

  1. A LEGO Account gives you (and to a limited degree your child) the opportunity to use your LEGO Membership as described in these Terms and Conditions.
  2. Your username or nickname may not be discriminating, unethical or in any other way offensive. Nor may it contain your name or other personal identifiable information.
  3. Uploaded material may not be illegal, misleading or violate anyone's rights.
  4. Games, message boards or email forms at LEGO.com or in LEGO apps may not be misused or manipulated in any way.
  5. If you have accepted that your child may participate in competitions sponsored by the LEGO Group, we will send you a notice of the competition terms with the possibility of opting your child out of participating.
  6. You must comply with all specific terms and conditions, policies and/or guidelines using LEGO Group experiences as stated in the Services.

Failure to comply with the above may, in the LEGO Group’s discretion, lead to suspension, revocation of membership and/or privileges or to a deletion of your Program membership and as part of this your LEGO Account. If Program membership privileges are revoked, this may result in the loss of points earned, status, benefits, loss of access to Services, such as games, or discontinuation of the LEGO Program membership and deletion of your LEGO Account. You should familiarize yourself with the specific terms and conditions or policies or guidelines that apply to each Service as they are stated in the specific Service.

Consenting as a parent or legal guardian

If you are a parent or legal guardian, we are asking for your parental consent. If your child wants to use our Services that are not available for use by children under the age of majority without a parent giving consent, you will need to validate the LEGO Account your child has created and provide us with valid contact information. Having a LEGO Account will also give you the opportunity to control how your child can use our Services. What Services can my child access as a Program Member?

Provided and to the extend you as a parent or guardian has given your verified consent, your child can choose from various Services and features such as signing up to different digital activities, if eligible, choosing personalized avatars, making anonymous comments, uploading creations, and participating in our competitions.

Activities will change or vary by digital experience. Therefore, we urge you from time to time to adjust the privacy settings made on your child’s behalf in the LEGO Account “Family Settings” page.

Please note that some Services will not be available for your Child to use as they are not appropriate for children under the age of majority. For example, the LEGO VIP loyalty element of the Program is not available for a Child to use.

What Services can my child access with a Linked LEGO® Account?

All of the things mentioned as examples under ‘What Services can my child access as a Program Member?’ and in addition the chat functions, as well as uploading and sharing created content.

More specifically, you are able to control the settings for your child through your Verified Profile – and give access to Services as well as control what features you have given your child permission to use.

3. LEGO® VIP loyalty program (‘VIP Program’)

What is the VIP Program?

The VIP Program is the loyalty and benefits element of the overall Program for eligible Members.

Eligibility

Persons eligible for the Program are limited to natural persons who are at least eighteen (18) years old (or of the age of majority in your country or jurisdiction of residence whichever is higher) and who are residents in a country in which the Program is offered. A Member may only submit and maintain one application for membership in the Program, and the Member may only have one LEGO® Account in the Member’s legal name. Corporations, associations, or other groups or legal entities, may not apply to become a Member of the VIP Program or participate in the Program.

The country of residence is deemed the actual physical home of the Member. Details about the person and the residence must be submitted accurately and truthfully and updated promptly by the Member if changed. Upon request, proof must be provided to the LEGO Group, the LEGO Group entity, or the participating LEGO® Certified Store or LEGOLAND Discovery Center Store operator in question where the Program signup takes place.

Based on factual and non-discriminatory reasons, it is the LEGO Group's sole decision to allow (or disallow) an eligible person to become a Member (and grant them a LEGO Account). In case of exclusion of the Program or rejection to become a Member, the LEGO Group will provide a written justification stating the reasons for the exclusion/rejection.

Program membership signup

A person can sign up to become a member of the Program in the following ways:

a) Signing up in a physical LEGO Store or Participating Third Party LEGO Stores (find a local, participating store here: https://www.lego.com/stores)

b) By calling Customer Service at 1-844-903-5346, and subsequently, through use of a confirmation code or link in an email received upon in-store signup confirming the LEGO Account and LEGO VIP Program membership. The sign-up process will not be completed until a LEGO Account has been created and the VIP Program Card has been connected to the LEGO Account profile.

c) Signing up on LEGO.com/VIP and creating a profile.

A Member will need to provide the following information when signing up:

  • Name of the member (full name)
  • Valid email address
  • Birth date and year
  • Country & region/state/province/district of residence

The Member guarantees the correctness of all information given. The Member shall be the only person responsible for any erroneous, incomplete, or out-of-date information.

The Member is the only person responsible for maintaining the confidentiality of its access credentials and other LEGO Account profile information and will be solely liable for activities on the Member’s profile. Members agree to notify LEGO Customer Service immediately of any unauthorized use or breach of security related to the Member’s LEGO Account profile or access credentials.

The VIP Program membership starts when a LEGO Account profile is opened, i.e., upon completion of the registration process. If the applicant is already a Member, a new application for opening another profile is invalid, as only one LEGO Account profile can be opened and maintained per person.

LEGO Account

Members’ LEGO Account is used for personal identification, e.g., when checking your online VIP Program Member profile and accessing the Program Redemption Center. A LEGO Account profile is required for participation in the Program hereunder the VIP Program.  

VIP Program Card

Once the Member has registered his/her VIP Program profile, an electronic VIP Program Card will be issued and can be installed and accessed via the Apple Passport App or Google Pay. If requested by the Member, a physical VIP Program Card will be sent to the Member, if the LEGO Group has not phased out the physical VIP Program Cards beforehand. 

Member’s status

The LEGO Group reserves the right - in its sole discretion - to make the following personalized offers available to Members, e.g., based on their Program activity, Points status and history, country of residence, shopper history, product preferences, and Rewards history:

• Special Rewards and benefits

• Promotional offers/activities

The terms and conditions for such personalized offers, including the nature, duration, and availability will be presented in connection with each personalized offer in question and may vary from time to time.

4. Earning Points – applicable only to legally adult members

General information

The VIP Program allows each adult Member to accumulate and redeem loyalty points (“Points”) and to use such Points on “Rewards” (as defined below) within each Member’s own LEGO® Account profile.

Points and subsequent Rewards must be gained, earned, and used in accordance with the rules and guidelines in these Terms and Conditions. The LEGO Group has the final authority to decide whether an activity qualifies for Points and/or Rewards.

Points

The VIP Program may be structured to offer certain benefits based on the Member's current balance of:

  • ‘Redeemable’ Points: Meaning Points that have not previously been redeemed or
  • ‘VIP Program Points’: Meaning the total amount of Points accumulated by a Member, whether previously redeemed or not.

The LEGO Group reserves the right to suspend, terminate, revaluate, or modify - with reasonable notice to redeem Points - all or part of this internal Points or Rewards value structure and offers, and any merchandise or service.

Rewards

From time to time, the LEGO Group may offer benefits or privileges (“Rewards”) to Members in exchange for redemption of:

  • A specified number of Member’s Points or
  • As a result of a specifically defined action undertaken by the Member.

Rewards can include and take form of:

  • A discount when purchasing LEGO® products or services on LEGO.com, participating LEGO Stores, LEGO Certified Stores, and/or LEGO Discovery Center stores (LEGO Certified Stores and LEGO Discovery Center stores are jointly referred to as “Participating Third Party LEGO Stores”). All LEGO Stores and Participating Third Party LEGO Stores are listed here: https://www.lego.com/stores and will be updated by the LEGO Group from time to time at its sole discretion.  

  • A digital image download of LEGO products or assets available in the Redemption Centre.
  • Voucher codes for discounts or merchandise are redeemable on LEGO.com or third-party websites.

At all times, there will be a list of Rewards offered for redemption, and the terms and conditions connected thereto is available at the Member’s VIP Program Redemption Center page here: https://www.lego.com/vip.

The nature of Rewards, and the number of Points or the actions required to obtain such benefits or privileges, shall be established by the LEGO Group in its sole discretion, may change/be increased from time to time and may be available for limited periods or a limited number of times.

There may be a limited number of a particular Reward available, and for those Members with access to the particular Rewards, the Rewards will be delivered on a first-come, first-served basis.

The LEGO Group reserves the right to modify or withdraw the available Rewards. Restrictions may be imposed upon any Reward or its redemption by the LEGO Group. Members may not rely on continued Reward availability.

Rewards have no cash value. Rewards are non-transferable and may not be bartered or sold.

The LEGO Group reserves the right to substitute Rewards of comparable or greater value if any redeemed Reward becomes unavailable for any reason.

How to earn Points

Members can start earning Points after the VIP Program commences.

Points can only be credited to the Member’s individual Member profile for:

  • A Qualifying Purchase of a LEGO® product in: A LEGO Store, www.LEGO.com, or in a Participating Third-Party LEGO Stores,
  • Activities attributable to a Member (unless otherwise specifically stated in these Terms and Conditions, or the specific terms related to offers, activities or promotions made by the LEGO Group).

The Points will be added to the LEGO Account profile at the time of payment. Please note that when purchasing by phone or online, payment occurs when the qualifying order is shipped. It may take up to 24 hours after payment before the earned Points appear in the Membership profile or are available in the Redemption Center for use.

Qualifying Purchases are defined as:

  • Merchandise and services available for purchase (unless otherwise specifically stated in these Terms and Conditions, or the specific terms related to offers, activities or promotions made by the LEGO Group)
  • Redemption of a valid gift card against purchase of goods or services.

The LEGO Group may decide to introduce additional ways of earning Points from time to time. Additional terms and conditions may apply and will be stated clearly in the description of the Service.

Members may also earn Points in other ways, as specifically communicated by LEGO Group in emails or online postings from time to time.

To earn Points for online purchases on LEGO.com, the Member must sign into their LEGO Account before making the purchase. To earn Points in a LEGO Store or in Participating Third Party LEGO Stores, the Member must provide the VIP Program Card at the time of the purchase. To earn Points for telephone purchases, the VIP Program needs to be registered and the Member must provide the VIP Program Card number when placing the order by phone.

Points are not valid unless earned in compliance with these Terms and Conditions or specific terms established and intended by the LEGO Group.

Bonus Points

The LEGO Group may also, in its sole and absolute discretion, award “Bonus Points” for certain actions such as early enrollment or frequent activity. Additional rules and restrictions may be established by the LEGO Group from time to time and apply to such Bonus Points.

Member Benefits

Some limited Services (“Benefits”) may be made available by the LEGO Group to the Member from time to time without requiring use of Points. Availability of such Benefits will always be subject to specific terms and conditions and always at the discretion of the LEGO Group.

Related charges and taxes

Applicable postage/shipping charges are excluded for Point earnings. In certain countries (for example, the United States of America and Canada), the taxes are separate from the purchase prices and therefore excluded for Point earnings.

Other loyalty programs in LEGO Certified Store or LEGOLAND Stores or LEGOLAND Discovery Center Stores (“Third Party LEGO Stores”)

A Third-Party LEGO Store operator may have or may participate in similar customer loyalty programs to the VIP Program.

Currently, the Program (and hereunder the VIP Program) does not cover any rights or benefits in such other programs of any Third-Party LEGO Store operators or their affiliates.

Third party Rewards

The LEGO Group is not responsible for Rewards, Services or Benefits delivered by a third party. Please read more about this in the section 9 “Limitation of liability” below.  

How is the value of Points calculated?

The method for calculating the Points is the same globally. However, the number of Points a Member will earn on the purchase of a particular product will differ from country to country, as the prices for the same goods in different markets may vary'. The Points and Awards allotment principles can be found here: https://www.lego.com/service/help/lego_vip/lego_vip/what-are-lego-vip-points-worth-kA009000001dbuZCAQ and will be updated from time to time.

Members may accumulate Points to earn a discount on Qualifying Purchases or to use on Rewards available in the Redemption Center.

The Points value will be calculated using the Points value for the country in which the Qualifying Purchase is made.  

Redeeming Points

Points can be redeemed in:

  • Eligible LEGO Stores,
  • Participating Third-Party LEGO Stores,
  • On LEGO.com in our Redemption Center for Rewards.

Points have no cash value and can never be exchanged for cash or gift cards. Further, Points are not regarded as electronic money, unless this follows from applicable legislation, including indispensable consumer protections rules.  

The following actions are prohibited: Purchase, sale/resale, brokerage, barter, or exchange of Points/extra Points or Rewards or Benefits for any compensation.

While a Member can earn Points in all participating LEGO Stores, Participating Third Party LEGO Stores or on LEGO.com, the Points can only be redeemed in the Member’s country of residence.

It is not possible to redeem Points during the same transaction in which they are earned unless otherwise specifically stated in these Terms and Conditions or the specific terms related to an offer or promotion made by the LEGO Group.

Points can only be redeemed in the countries where the Program is available. You can find a list of those countries here: https://www.lego.com/en-us/service/help/lego_vip/lego-vip-program-availability-kA009000001dbuYCAQ . The Points value per participating country may be updated from time to time by us, but this information is not available to you as a Member.  

Please note that the LEGO Group considers it a misuse, if a Member seeks to manipulate the VIP Program to the Members’ advantage by earning Points in one country and redeeming them or shipping purchases made by redeeming them to a different country. Occasional purchases such as these are permissible, but a pattern of such activity would be considered fraudulent behaviour and will entitle us to cancel your membership in the Program without further notice.

Returned products

If a product is returned for a refund, any Points or double Points earned or redeemed for the purchase will be handled and reduced in accordance with the return policies of the participating LEGO Store and the Participating Third-Party LEGO Store from which the Member made the purchase, e.g., via an in-store credit or a voucher. Any Benefit, hereunder as an example a gift with purchase, received when purchasing the product must be returned with the product.

If Points have been used for a Reward, such Reward cannot be returned, and redeemed Points cannot be reinstated unless otherwise allowed under the terms and conditions for the Reward.

Expiration of Points or Deactivation of LEGO Account and VIP Program

All Points will expire after 18 months VIP Program inactivity.  Activity is defined as earning or redeeming Points. In terms of the VIP Program profile activity, the 18 months will be rolling and will be reset at the time of activity.  

Prior to expiry of your Points/VIP Program deactivation, we will provide you with reasonable notice allowing you to reactivate to keep your Points and/or your VIP Program profile.

The LEGO Group will send you a reminder email at least 60 days before Points’ expiration and in case of inactivity, at least 60 days before deactivation of your VIP Program profile takes effect.

If your overall LEGO Account has been inactive for 3 years, we will delete your account and all the personal data contained in the account unless we are required for legal reasons to keep such data for longer. Upon deletion of your LEGO Account, you will no longer be a Member of the Program. FOR THE AVOIDANCE OF DOUBT: POINTS ARE NOT TRANSFERABLE UPON DEATH, AS PART OF A DOMESTIC RELATIONS MATTER OR OTHERWISE.

5. Intellectual property rights

How about your own and your child’s IP rights?

You and your child retain your individual copyright before submitting, posting, or displaying content on or through our Services. However, you individually grant to us a limited license, so that we can make the content accessible and usable on our LEGO Group platforms without any limitation for an indefinite period. The license you individually grant to us and companies within the LEGO Group is a non-exclusive, transferable, sublicensable, royalty-free, worldwide license to use and modify the content submitted, posted, or displayed on or through our Services, including for use on any platform or media for promotional purposes.

Also, if you or your child posts content in a part of our Services that includes functions where multiple users may post, edit, or delete items, then by submitting your content to that area, you are individually allowing other users to use the submitted content in this way. Make sure that you and your child have the necessary rights to grant us this license for any content that you submit to our Services.

How about our IP rights?

We own or control all materials that appear on our Services. This includes all intellectual property rights such as trademarks, trade names, slogans, logos, designs, graphics, fonts, pictures, text, content, images, or other materials, including all domain names, copyright, moral rights, patents, and trade secrets.

All such intellectual property rights belonging to or being controlled by  the LEGO Group are hereby asserted, reserved and remain with the LEGO Group, and you or your child may not make any unauthorized use thereof, including using content in a way that is likely to cause confusion among consumers, using content in a commercial manner, or otherwise infringe the LEGO Group’s rights or any Terms of Use of the LEGO® website or any terms related to specific Services offered by the LEGO Group.  

We give you and your child a personal, worldwide, royalty-free, non-transferable, non-sublicensable and non-exclusive license to private and non-commercial use of the software and content provided by the Services, until either your or your child’s LEGO Account is terminated. This license is for the sole purpose of enabling you and your child to use and enjoy the benefit of the Services provided by us in the manner permitted by these Terms and Conditions.  Unless expressly stated in the terms applicable to a particular Service, you are not permitted to copy, modify, or create derivative works from any software or content made available to you by the LEGO Group.

6. Members’ content and content moderation

What is our obligation?

Where applicable laws require so, we will respond to legitimate requests by authorities or court orders to disclose your and your child’s information.

We monitor our users’ content and communications; however, we cannot guarantee that our Services are free of illegal material or other content that may be considered unacceptable. When it comes to our attention, we will review content to determine whether it is illegal or violates our Terms and Conditions and thereafter take all necessary steps that may be required by applicable law. We may remove the content or refuse to display it. In serious instances of abuse, we may also notify the police or relevant law enforcement agency.

We provide our Services for personal entertainment on an “as is” and “as available” basis. We give no warranty in connection with our Services, including that Services will work for a particular purpose or will work perfectly.

What is your obligation?

We respect other people’s rights and expect you and your child to do the same. Neither you nor your child may post content or take any action on our Services that infringes or violates someone else’s rights, our rights or otherwise violates the law.

You or your child may not use content from our Services unless you obtain permission from us or if the use is otherwise permitted by law. If any of you see something that might be an issue and want to notify us, please contact Customer Service, here: https://www.lego.com/service/contact-us

You agree to indemnify and hold us harmless against all liability in respect to and arising out of your and/or your child’s use of our Services.

Where and how do we moderate?

If our channels are directed at kids, we moderate everything before it goes live. On mixed age group channels such as LEGO® Account, we ask for clear parental consent. Anything that is uploaded here will be post-moderated. For channels only directed to and accessible by legal adults, we do post-moderation only.

We may remove any content or information you or your child posted on or via our Services if we believe that it violates our Terms and Conditions or is otherwise objectionable.

Certain content that is sent through our Services (such as discussions in chats, upload of images etc.) may or may not be removed at our discretion. This is to ensure the continuity and safety of discussions in our Services.

7. Personal data, data privacy and audit

What are you consenting to in relation to your child?

As a parent or legal guardian, you are consenting to your child’s use of our Services and the terms connected thereto, and that we can collect personal information from your child and use your child’s user-generated content and make it accessible and usable on our LEGO platforms.

When you have accepted our Terms and Conditions, you will get a LEGO® Account profile. As a parental approver, your child’s LEGO Account profile will be updated based on your consent and you will be given a separate parental Verified Profile enabling you to have control.

How will you be consenting as a parent?

We collect your parental consent in two different situations. If your child just wants to play around on our Services with us knowing who your child is, but not disclosing it to others, we are asking for your consent to be sent by email – we call this the “LEGO Account profile”.

If your child wants to engage more actively, disclosing his or her identity to other users or being more active, then we will need to verify your consent in a secure way – we call it a” linked LEGO Account profile”, because it is linked with a “Verified Profile” owned by a parent or a guardian. In both instances, you guarantee us that you are the parent or legal guardian of the child and that you are 18 years (or the age of maturity in your country of residence whichever is higher).

Use of personal information in the Program

LEGO System A/S collects, retains, and processes personal data about you in accordance with all applicable data protection laws, including the General Data Protection Regulation and applicable local data protection legislation.

If you have given us your parental consent, please help your child in understanding what privacy rights mean and what these Terms and Conditions mean for your child in that respect.

Please note that some Rewards, Benefits, promotions, sweepstakes or offers are delivered and operated by independent third parties to the LEGO Group and may be subject to separate privacy conditions and may ask for separate consent of use of your personal information. The LEGO Group will inform you that you are leaving the LEGO platform / website. Please make sure you read those terms and conditions carefully before agreeing.

Please note that we may change our Privacy Policy from time to time and so we recommend that you check our Privacy Policy frequently to ensure you are aware of any changes.

Auditing

LEGO Group reserves the right to audit any and all LEGO Accounts in the Program at any time and without notice to the Member to ensure compliance with the Program rules.

In the event that an audit reveals discrepancies or violations, the processing and / or use of Points or Rewards may be delayed by us until the discrepancies or violations are resolved to our reasonable satisfaction. During such audit and until the result of such audit is available, Members may be prohibited from redeeming Points and using Rewards, services, or benefits associated with the Program, as determined solely by us.

LEGO Group also reserves the right to exchange information with our LEGO Group entities, LCS store partners, trusted partners, and service providers or their agents for auditing purposes.

Third party

All data, including personal data, shall be used and exchanged by LEGO Group, the LEGO Group entities, trusted partners and service providers, and Participating Third Party LEGO Store partners as required by the Program, as further set out in the Privacy section above and in the LEGO Privacy Policy, available here: https://www.lego.com/legal/notices-and-policies/privacy-policy/

8. Technical malfunctions and force majeure

The LEGO Group is not responsible for any technical malfunctions, failures or difficulties, or other errors of any kind or nature; or for the incorrect or inaccurate capture of information, or the failure to capture any information.

Additionally, the LEGO Group is not responsible or liable for any computer, programming, printer errors or the issuance of any unintended Points or Rewards. The LEGO Group reserves the right to correct such errors. If Points, Rewards or Benefits are credited to the Member’s Profile by mistake, the LEGO Group reserves the right to cancel or remove such Points, Rewards or Benefits.

Force majeure

In the event the LEGO Group is prevented from continuing with the Membership or VIP Program by any force majeure event beyond its control and that could not reasonably have been foreseen or prevented by reasonable precaution, including any hardship, any natural disasters such as earthquake, explosion, labour dispute or strike, act of God or public enemy, satellite or equipment failure, computer virus or hacking, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared), or any federal state, provincial, territorial or local government law, order, or regulation, public health crisis, epidemic, pandemic, order of any court or jurisdiction, or other cause not reasonably within LEGO Group’s control (each a “Force Majeure” event or occurrence), the LEGO Group shall have the right to suspend or cease provision of Services covered by the Program, in whole or in part.

9. Changing the services

How will we update functionalities?

We are constantly changing and improving our Services. We may add or remove functionalities or features. Occasionally, we may have to interrupt our Services and make changes to certain technical specifications and product features.

How will we update these Terms and Conditions?

The LEGO Group reserves the right to unilaterally change the Terms and Conditions of the Program, including suspending or cancelling any parts of the Program in the following cases:

  • When necessary following legislative changes
  • If the Program is no longer profitable for the LEGO Group or
  • If deemed unnecessarily burdensome – for technical or commercial reasons - for the LEGO Group

When we update our Terms and Conditions, and the change is not material to the provision of our Services covered by this Program, we will give you notice in advance either by posting the change on our Services and/or by contacting you directly.  

The LEGO Group will inform you as a Member directly, e.g. via email, at least 60 days before any material change takes effect, and at the same time inform you as a Member of the possibility of terminating the contract before any material change takes effect.

At any time, you are free to discontinue your membership of the Program.

10. Limitation of liability

The LEGO Group is not a party to any agreement entered into between you as a Member and a Participating Third-Party LEGO Store or any other third party to the LEGO Group. The LEGO Group has no responsibility for goods or services delivered by any third-party Program operator.

To the maximum extent permitted by law, the LEGO Group excludes liability for any loss or damage of any kind arising out of your and/or your child’s use of our Services.

Neither the LEGO Group or the LEGO Group entities shall be liable for any loss, expense, including attorneys' fees, accident, or inconvenience that may arise in connection with the use of Points or Rewards or Benefits, or as a result of any defect or failure of Rewards save to the extent in which such damage or loss arises out of the LEGO Group’s misconduct or negligence, except as otherwise provided by indispensable applicable laws.

Lost, stolen, or expired Points or Rewards will not be refunded, replaced, or extended.

LEGO Group shall not be liable for any loss or damage resulting from the termination – with reasonable notice in terms of redemption of Points - of, or changes in the Program given with due notice as reflected in section 9 “Changing the Services” above. No damage claims against LEGO Group by Members may be filed as a result of legally required or recommended country-specific alterations.

The Program and/or any Rewards are void where prohibited by law.

Laws applicable in certain countries may impose restrictions upon the Program. Due to local laws and regulations, the LEGO Group may not be able to make available the Program or parts thereof in certain countries or to certain individuals. LEGO Group will not be liable when complying with such local laws and accordingly reserves the right to terminate – with reasonable notice in terms of redemption of Points, to the extent legally permitted – the Program for individual Members and cancel Points or Rewards such Member may have accumulated.

The Member is liable for any claims raised by third parties, including the tax authorities, arising from the Program, its Points, Benefits and/or Rewards.

11. Termination and deletion

Your termination

If you’d like to stop using our Services, simply follow the instructions within the relevant service or delete your LEGO Account profile here. Your LEGO Account and Program membership can be cancelled by you at any time.

You may terminate or cancel your membership of the Program at any time by contacting the LEGO Group through our Customer Service, either by phone, email, or through the Customer Service webpage, here: https://www.lego.com/service. When contacting Customer Service, you will be asked security questions relating to your LEGO® Account profile to verify that it is your Program membership profile.

In general, we do not retain your personal information for longer than necessary for the purposes for which it is processed. However, we may need to retain some personal information related to you and your child, even if you delete the LEGO Account profile. Content that is deleted from our Services may also remain in back-up storage for some time. In addition, such content may be anonymous and aggregated and used for various purposes such as research and analysis. Please note that when you terminate or cancel your Program membership, your Points will be deleted after a reasonable notice.

Please be aware that LEGO applications and services using your LEGO Account may need to retain your LEGO Account information for a period of time for legitimate purposes, even after you have closed your Program membership profile. Please read more in our Privacy Policy and in the terms related to the specific LEGO® applications and services that you have signed up to.

Our termination

If you or your child violate the letter or spirit of these Terms and Conditions, or otherwise create risk or possible legal exposure for us, we can stop providing all or part of our Services to you or your child with or without notice, and either of you may lose your content, any virtual items, and Program membership profile(s) including your LEGO® Account, and any Points, Rewards or Benefits accrued. In all such cases, we are entitled to terminate this agreement and immediately remove, cancel, or suspend access to and your use of our Services.

Fraudulent behaviour etc.

In case of any improper use, misuse or fraudulent behaviour detected by the LEGO Group, the LEGO Group reserves the right to deduct or reduce the Points, terminate the Program, deactivate the LEGO Account profile, cancel, or withdraw Points, Benefits or Rewards, refuse to issue new Points, Benefits or a Reward, and refuse to accept the redemption of existing Points, Benefits or Rewards.

LEGO Group, in its sole discretion, reserves the right to disqualify and terminate participation of anyone exhibiting any fraudulent behaviour such as:

(i) tampering with the operation of the Program

(ii) Member shall not attempt to earn Points by circumventing the LEGO Group’s technical setup, including attempts to access LEGO Account profiles via a bot script or other brute-force attack

(iii) acting in violation of these Terms and Conditions, or the LEGO Terms of Service, or any other incorporated terms

(iv) assigning, bartering, or selling any digital Points, Benefits or Rewards

(v) acting in an unethical or disruptive manner

(vi) acting with intent to annoy, abuse, threaten, or harass the LEGO Group, its representatives, or any other person in any manner related to the Program

(vii) tampering with, altering, or attempting to alter Points standings,

(viii) tampering with, altering, attempting to alter, creating, attempting to create or duplicate Points, or

(ix) using a single LEGO Account profile or Program membership for the purpose of accumulating Points or Rewards for combined use

(x) colluding or attempting to collude with one or more Program Member profile holders to gain an unfair advantage by sharing knowledge or other information in order to earn Points

(xi) acting as a person when you are in fact a company in order to gain unfair advantages and in order to earn points

Loss, theft, or damage of the Membership Card must be reported immediately to the Customer Service Center. Upon the Member's notification of a lost, stolen, or damaged Card, the Card will be replaced/reissued. LEGO Group is not liable for any fraudulent use of the VIP Program Card or failure of the Member to comply with the contents of these Terms and Conditions, except if caused by LEGO Group’s willful misconduct or gross negligence.

Violators, including any Member who uses purchased or bartered Points or Rewards, shall be liable for damages and litigation costs.

The Program may make available third-party offerings or link to third-party platforms (e.g., social media platforms, reward, or promotions operators). LEGO Group will inform you on screen when you are leaving our site.

Please note that these other websites are not under LEGO Group’s control and LEGO Group has no responsibility or liability for the content of such webpages or platforms or for your interactions with the providers of such webpages or platforms. Further, please be aware that such webpages or platforms may be subject to other terms and conditions for use and privacy that are outside of our control.

The inclusion of any such link does not imply endorsement of the website by LEGO Group or any association with its operators. Any matter in relation to such third-party partner shall be solely between you and the third-party partner in question.

Entire agreement, applicable law, and place of jurisdiction

These Terms and Conditions make up the entire agreement between the LEGO Group and you as a Member, unless supplementary terms apply in relation to a specific Reward, Benefits, promotions or the like, cf. the above.    

This agreement is subject to and interpretated in accordance with Danish law, excluding the rules on conflict of laws and the United Nations Convention on Contracts for the International Sale of Goods if this would lead the the use of another country’s law, and the jurisdiction of the Danish Courts. The protection afforded to the Member by provisions that cannot be derogated from by agreement by virtue of the law applicable at the place where the Member is domiciled shall remain unaffected as well as the dispute resolution venue following mandatory consumer protection rules and rules on civil procedure.

To the extent that applicable laws in the jurisdiction where the Member resides conflict with the provisions of this Agreement, we will comply with the requirements under the applicable laws.

Arbitration Provision; Class Action Waiver (Applicable To U.S. Members Only).

By participating in the Program in any way, you unconditionally consent and agree that: (1) any claim, dispute, or controversy (whether in contract, tort, or otherwise) you may have against LEGO Group and / or its parent, subsidiaries, affiliates, and each of their respective members, officers, directors, and employees (all such individuals and entities collectively referred to herein as the “LEGO Entities”) arising out of, relating to, or connected in any way with the Program or the determination of the scope or applicability of this agreement to arbitrate, will be resolved exclusively by final and binding arbitration administered by JAMS and conducted before a sole arbitrator in accordance with the rules of JAMS; (2) this arbitration agreement is made pursuant to a transaction involving interstate commerce, and shall be governed by the Federal Arbitration Act (“FAA”), 9 U.S.C. §§ 1-16; (3) the arbitration shall be held in Los Angeles, California; (4) the arbitrator’s decision shall be controlled by the Terms and Conditions of this Agreement and any of the other agreements referenced herein that the applicable user may have entered into in connection with the LEGO website or the LEGO VIP Program; (5) the arbitrator shall apply California law consistent with the FAA and applicable statutes of limitations, and shall honour claims of privilege recognized at law; (6) there shall be no authority for any claims to be arbitrated on a class or representative basis. Arbitration can decide only your and / or the applicable LEGO Entity’s individual claims; the arbitrator may not consolidate or join the claims of other persons or parties who may be similarly situated; (7) the arbitrator shall not have the power to award punitive damages against you or any LEGO Entity; (8) in the event that the administrative fees and deposits that must be paid to initiate arbitration against any LEGO Entity exceed $125 USD, and you are unable (or not required under the rules of JAMS) to pay any fees and deposits that exceed this amount, the LEGO Group agrees to pay them and / or forward them on your behalf, subject to ultimate allocation by the arbitrator. Additionally, if you are able to demonstrate that the costs of arbitration will be prohibitive as compared to the costs of litigation, LEGO Group will pay as much of your filing and hearing fees in connection with the arbitration as the arbitrator deems necessary to prevent the arbitration from being cost-prohibitive; and (9) with the exception of subpart (6) above, if any part of this arbitration provision is deemed to be invalid, unenforceable, or illegal, or otherwise conflicts with the rules of JAMS, then the balance of this arbitration provision shall remain in effect and shall be construed in accordance with its terms as if the invalid, unenforceable, illegal, or conflicting provision were not contained herein. If, how-ever, subpart (6) is found to be invalid, unenforceable, or illegal, then the entirety of this Arbitration Pro-vision shall be null and void, and neither you nor the LEGO Group shall be entitled to arbitrate their dispute. For more information on JAMS and / or the rules of JAMS, visit their website at www.jamsadr.com.  YOU HEREBY WAIVE, WITH RESPECT TO ANY DISPUTE HEREUNDER: (I) THE RIGHT TO PARTICIPATE IN A CLASS ACTION, PRIVATE ATTORNEY GENERAL ACTION OR OTHER REPRESENTATIVE ACTION IN COURT OR IN ARBITRATION, EITHER AS A CLASS REPRESENTATIVE OR CLASS MEMBER; AND (II) THE RIGHT TO JOIN OR CONSOLIDATE CLAIMS WITH CLAIMS OF ANY OTHER PERSON.
