PayPal Days: Terms and Conditions By participating in the PayPal Days Program (the “Program”), you agree to the following terms and conditions (the “Terms”). In these Terms, reference is made to services offered by PayPal to its users, including, but not limited to, PayPal 4X Payment, which are subject to separate terms and conditions (the “PayPal Terms”). . When you use these services, the latest version of the PayPal Terms applies in addition to these Terms, including: - the Conditions of Use of the PayPal service - the General Conditions of Payment in 4X
1. Promotional Period
The Program begins at 12:01 a.m. on November 17, 2023 and ends either at 11:59 p.m. (local time in mainland France) on November 27, 2023 or until the threshold of 11,000 (eleven thousand) Rewards, all Selected Merchants combined, has been reached depending on the first of these two events (the “Promotional Period”).
2. Eligibility and general description
To be eligible, each Participant (an “Eligible Participant”) must: (1) be at least eighteen (18) years old; (2) reside in France; (3) have a valid private French PayPal account (a “Valid Account”) during the Promotional Period; and (4) having become aware of the Program via the Program website, via banners displayed on your PayPal account, on the Selected Merchants' website or on online media, or via an email from PayPal inviting you to participate to the Program (the eligibility of those who receive such communication is determined exclusively by PayPal) (the “Program Promotion”) and (5) follow the steps presented below (see in particular “3. Operation”).
The Program is limited to the first 11,000 (eleven thousand) Eligible Participants on a “first come, first served” basis.
3. Operation
To receive a Reward, the Eligible Participant must make a Qualifying Purchase during the Promotion Period. Then, PayPal will credit the Reward to the Eligible Participant's valid Account. Once credited to the Eligible Participant's Valid Account, the Reward will automatically be used for the Eligible Participant's next purchase made before December 31, 2023 with their Valid Account with one of the Selected Merchants (the “Next Purchase”). Eligible Participants who have agreed to receive marketing emails from PayPal will be notified of the awarding of the Reward. For other Eligible Participants to whom a Reward will be awarded, they will not be informed of the granting of the Reward, but the Reward will be available on their Account valid for the Next Purchase.
4. Eligible Purchases
An “Eligible Purchase” means a purchase whose amount is between 30 (thirty) euros and 2,000 (two thousand) euros, made at participating merchants, namely: Electro Depôt France, Bonprix, Groupe Courir, Micromania, Microsoft, But, Lego, Rakuten (collectively, the “Selected Merchant(s)”) using PayPal Pay in 4 Payment, via a valid Account during the Promotional Period. This PayPal Pay in 4 Payment must be the first PayPal Pay in 4 Payment transaction since the creation of this valid Account. The Eligible Participant must make only one Eligible Purchase to be eligible for the Program. The Qualifying Purchase must be made with PayPal Pay in 4 Payment in accordance with the PayPal Terms. PayPal Pay in 4X is offered subject to acceptance by PayPal and subject to the PayPal Conditions. Eligible Purchases do not include: (1) money sending/receiving transactions (including those indicated as payments for “Goods and Services”), (2) donations to charitable organizations, (3) purchases made through PayPal.me; (4) purchases made other than through your valid Account, (5) in-store purchases from Selected Merchants, (6) transactions made in any currency other than the Euro or (7) paid purchases other than with PayPal Pay in 4X.
5. Reward
The amount of the Reward is 10 (ten) euros (the “Reward”). Once the steps described above have been completed and verified, the Reward will be available in the Eligible Participant's valid Account within approximately 8 (eight) days after verification of the Eligible Purchases. During the Promotional Period, there is a limit of one Reward per valid Account. In total, only 11,000 (eleven thousand) Rewards are available to all Selected Merchants during the Promotional Period; and no Reward will be awarded once this limit is reached. The Reward does not constitute electronic money, is not included in your PayPal balance, has no cash value and cannot be exchanged for cash, or transferred out of the Eligible Participant's Valid Account . The Reward is separate and distinct from the PayPal balance. The Reward cannot be used for Qualifying Purchase. The Reward can be used, from the day the Reward is available on your Account valid until December 31, 2023, for any Next Purchase (as defined in 3. above). If the total amount of the Next Purchase exceeds the value of the Reward, you must add a payment method to your valid Account in order to fund the remaining balance and use the Reward.
6. Receiving and using Rewards
The valid Account must be in good standing, as arranged in PayPal's reasonable discretion, from the time of participation in the Program until receipt of the Reward. Subject to reasonable notice to the applicable Eligible Participant, PayPal may offer an alternative Reward of equal value if, for any reason, PayPal is unable to honor the Reward. PayPal reserves the right to cancel, suspend or modify all or part of the Program at any time without notice, for any reason, in its reasonable discretion. PayPal reserves the right to review any Account or any transaction in connection with the Program, for any reasonable reason and upon reasonable notice depending on the circumstances, and to delay or cancel the delivery of the Reward. Before delaying or canceling the delivery of the Reward, PayPal will give the affected Eligible Participant reasonable notice, whenever possible, and the opportunity to object to the decision. Offers similar to the Program may occur at the same time; Eligibility for the Program does not constitute eligibility for any other offer. The Program is void where prohibited by law, or if the Eligible Participant's PayPal account or transactions are fraudulent, abusive, not conducted through legitimate channels, or illegal in any way. The Program is not transferable.
7. Other
If any item purchased using a Reward is returned after the Reward has expired, PayPal will refund the amount spent to the payment method used to pay for the First Qualifying Purchase, and any amount in excess of the value spent (i.e. i.e. the amount of the Reward) cannot be refunded. If the Reward Redemption Period (i.e. the period between the award of the Reward and December 31, 2023) has not expired, the value of the Reward will be returned to the Offers tab of the valid Account and may be used by the Eligible Participant until the end of the Reward Use Period. PayPal is not responsible for loss, theft, fraud, abuse, delay, incompleteness, illegibility, interruption, lateness, alteration, defective, misdirected, falsified or illegal in any way, emails, Rewards or documents or correspondence relating to the Program if the email address, valid Account or other information of the Eligible Participant is invalid, deleted or modified without written notice sent to PayPal by the Participant. Participants can access PayPal's privacy policy by clicking here or by contacting PayPal if they have any questions or requests regarding the exercise of their rights, confidentiality and data protection. Any matters relating to the Program will be resolved in PayPal's sole discretion and its decisions relating to the Program will be final and binding. In the event that a dispute has not been resolved through PayPal Customer Service, Participants may choose to access the European Commission's European Online Dispute Resolution Platform (ODR Platform), which can be accessed by clicking here, or submit a complaint to the European Consumer Center (ECC-Net) by clicking here.
8. Marketing Preferences when promoting the Program
As part of the promotion of the Program:
- if you no longer want to see the Program banner on your PayPal account, in your PayPal account settings, go to your Profile, then Data & Privacy and deactivate the option under Offer Preferences and commercial promotion also available here;
- if you no longer wish to receive emails from PayPal regarding the promotion of the Program, you can click here or:
- on the PayPal application go to your Profile, then to marketing preferences and deactivate the option titled: “offer”.
- on the PayPal web version, once connected to your profile, click on “Settings” then “Notifications” then in marketing preferences click on “chose what you want to receive” and finally deactivate the option titled: “here”.
9. Applicable law and competent courts
These Conditions are governed by French law. By participating in the Program, Participants agree to comply with these Terms and the PayPal Terms. The courts of France will have jurisdiction to settle any dispute or claim arising out of or in connection with the Program, these Terms.
10. Organizer
Services in connection with the promotion of the Program are provided by PayPal Pte Ltd, a company incorporated in Singapore, registered number 200509725E and whose address is 5 Temasek Boulevard, #09-01, Suntec Tower Five, Singapore 038985.
